Dv  Concession

The DV Concession, officially called the Migrant Victims of Domestic Abuse Concession (MVDAC), provides a short period of independent immigration status and access to public funds for certain partners who are victims of domestic abuse, allowing them to leave an abusive relationship. This concession provides a three-month period of leave to remain, during which the victim can apply for permission to stay under a relevant immigration route, apply for settlement on form SET(DV) if eligible under Appendix Victim of Domestic Abuse (Appendix VDA), or make arrangements to leave the UK. 

Eligibility: 

  • The MVDAC is available to partners of individuals with leave to enter or remain in the UK on a work or study route, or as a student or graduate. 
  • It is not available to partners of visitors, people with pre-settled status, or people with student or worker leave in their own right. 

Application Process: 

  1. Seek legal advice: It is recommended to seek advice from an immigration advisor. 
  2. Complete and submit the form: Submit the LOTR (DVV) form to the Home Office at domesticviolence2@homeoffice.gov.uk
  3. Biometric information: Provide your biometric information at a local Post Office after submitting your application, as required for applications for leave to remain longer than six months. 

Key Points:

  • The three-month permission to stay is intended to allow the victim to apply for other immigration options or make arrangements to leave the UK. 
  • During this period, the victim can apply for benefits, including local authority housing assistance. 
  • If a victim applies for ILR under Appendix VDA, the 3-month leave to remain will continue until a decision is made on their application. 
  • The MVDAC is a temporary measure and does not grant permanent rights to remain.
