What it is:

  • Not a distinct visa:
    The term "self-sponsorship visa" is a colloquial way of referring to a specific application of the Skilled Worker visa.
  • Company as sponsor:
    The individual establishes a UK company, which then acts as the sponsor, issuing a Certificate of Sponsorship (CoS) to them for a genuine job within the company.
  • Sponsor License:
    The UK company must obtain a Skilled Worker sponsor license from the Home Office before it can sponsor anyone. 
  • Meeting Skilled Worker Criteria:
    The individual, as the employee, needs to meet all the standard requirements for a Skilled Worker visa, including demonstrating a genuine job offer, salary, skills, English language proficiency, and financial means. 

How it works: 

  1. Establish or Acquire a UK Company:
    The individual either starts a new business in the UK or takes over an existing one.
  2. Apply for a Sponsor License:
    The company applies to the Home Office for a Skilled Worker sponsor license.
  3. Appoint an Authorizing Officer:
    The company needs to appoint an Authorizing Officer (AO), who is either a British citizen or settled in the UK.
  4. Meet Skilled Worker Requirements:
    The individual must meet all the requirements for a Skilled Worker visa, including a genuine job offer, salary, and skills.
  5. Obtain a Certificate of Sponsorship (CoS):
    Once the sponsor license is granted, the company can issue a CoS to the individual for the intended job.
  6. Apply for the Skilled Worker Visa:
    The individual then uses the CoS to apply for a Skilled Worker visa.

Key Considerations: 

  • Genuine Business Intent:
    The company must be genuine and active, with a clear business plan.
  • Financial Resources:
    The individual needs to have sufficient funds to support themselves and their business.
  • English Language Requirement:
    A minimum CEFR B1 level of English proficiency is required, as determined by passing an approved English language test. Must be at least 4.5 in all 4 categories.
  • No minimum turnover requirement for the company:
    There is no minimum turnover requirement for a UK company to apply for a sponsor license.
  • Can be a Director and Shareholder:
    The individual can be a Director and majority shareholder in the UK company, even owning up to 100% of the shares. 
  • Can bring family spouse and children under 18.
  • Does lead to indefinite leave to remain after 5 years.( must satisfy criteria) 

Fees

  • The sponsor license application fee is £536 for small or charitable organizations and £1476 for medium or large organizations
  • The fee for a Certificate of Sponsorship (CoS) is £525
  • NHS surcharge to be paid It is currently £1035 per year payable when you apply, ( must be paid in full for the duration of visa)
