What is the new rule for citizenship in the UK?

The UK government has introduced a new rule regarding citizenship, effective February 10, 2025, that will "normally" refuse citizenship to those who entered the UK illegally or arrived through dangerous routes, regardless of how long ago it occurred. This change impacts individuals who entered the UK in breach of immigration laws, including those who arrived through deception or via routes like small boats or vehicles.

  • Good Character Assessment:
    The new rule amends the guidance on the "good character" requirement for citizenship applications. This means that individuals who entered the UK illegally, or who arrived through dangerous routes, will usually be denied citizenship, regardless of how long ago this occurred.
  • Illegal Entry:
    The Home Office defines "illegal entry" as any entry that violates immigration laws, such as breaching a deportation order or entering through deception.
  • Dangerous Journeys:
    A "dangerous journey" is defined as a route that involves risks, such as traveling by small boat or being hidden in a vehicle. 
  • Impact:
    This change will affect many individuals who have gained refugee status through asylum claims or are currently in the asylum system. 
  • Previous Rule:
    Under the previous rules, illegal entry within the past 10 years could be disregarded if the individual had been granted Indefinite Leave to Remain (ILR) and no other character concerns arose, according to the Greater Manchester Immigration Aid Unit. 
  • Applications Submitted Before February 10, 2025:
    Applications submitted before this date will still be assessed under the previous rules, which allowed for some discretion in considering past immigration breaches.
